From the decision: "Simon Glik was arrested for using his cell phone's digital video camera to film several police officers arresting a young man on the Boston Common. The charges against Glik, which included violation of Massachusetts's wiretap statute and two other state-law offenses, were subsequently judged baseless and were dismissed. Glik then brought this suit under 42 U.S.C. § 1983, claiming that his arrest for filming the officers constituted a violation of his rights under the First and Fourth Amendments.
In this interlocutory appeal, the defendant police officers challenge an order of the district court denying them qualified immunity on Glik's constitutional claims. We conclude, based on the facts alleged, that Glik was exercising clearly- established First Amendment rights in filming the officers in a public space, and that his clearly-established Fourth Amendment rights were violated by his arrest without probable cause. We therefore affirm."Dogs are excellent judges of character, this fact goes a long way toward explaining why some people don't like being around them. The post was edited 1 time, last by Sarcasmtheelf ().

Just heard on the news a paddler went missing on Big Wills Creek, went over the dam and never came up. The water is high and going over the dam shouldn't have been an issue but from what I've heard sounds like maybe the boat flipped and was pulled under and the paddler never came up. Big Wills is behind my house and I paddle/fish that area a lot, the striper in my avatar was caught there.

- yes the officer could have handled it better - but he broke no significant law, he didn't steal the phone.
- Clearly he taught her a lesson... she wont be doing that again.
- I have caught people filming me and recording me discussing professionally while I was working. Its not fun. -Think - what would you do if someone did it too you?
- We have laws that are different by state, here in Pa "Audio recording without notify with a release is illegal."

2) It appears that she is on a public street and therefore has every right to be where she was. (most likely) Otherwise she should of been arrested for Obstruction and her phone used as evidence.
3) The officer may very well have committed a felony, depending on the value of the phone.
4) The only lesson he taught her is that he is a asshole.
I hate bad cops more than I hate most criminals
Well clearly these are difficult times to be an officer, I would thank most for their service.- Yes I have videoed officers on calls in the past and I was very respectful and turned in said videos to NBC, for cold cash. (its good money to be in the right place at the right time.) I was asked occasionally to turn off and I was asked who did I work for? (Me).. I was "stringing" mostly fires and explosions - to answer your post, I would say with some guessing here.

Yea I have had two incidents with bad cops, over some 50 years but they are so few and far between. One was so awful twentyfive years ago I remember his name. I would rather remember the good ones.
Enough of this - I actually came onto this thread to post something else- no biggie. Good nightBe wise enough to walk away from the nonsense around you!
