Last March planiffs had a lawsuit against fitbit claiming it caused a rash when worn, and today there is a class action lawsuit for inaccurately monitoring the heart, causing people to push themselves beyond there personal limits and in some cases causing harm. Now I know a product should work as claimed, but part of me is chucking inside and wanting to issue Darwin's. Coffee

Anyone using a Fitbit to do heart rate training is a simpleton....FWIW, YMMV, HYOH, and all that.Lost in the right direction.

I struggle with which is worse, the ambulance chasing lawyers that represent these kind of cases, or the people actually pursuing these type of cases.

A rash ? Try soap and water. If that doesn't fix it, they are allergic to whatever plastic the wristband is made of. Go see a doctor. Take care of your self, not blame a company.
Their site has a large amount of steps for weekly amount basedon some Heart group. I lowered it to 12,000 steps per week.--

Didn't they sell it with prominent disclaimers that the heart rate indication is for entertainment only, and they do not represent it as a medical device? (But of course, to plaintiffs' attorneys, a disclaimer doesn't mean anything. If they can find a merchant, anywhere, that represented its capabilities contrary to the disclaimer, they stand a good chance of winning.)I'm not lost. I know where I am. I'm right here.

The AT pushed me beyond my personal limits (I got real tired climbing Sinking Creek Mtn) and in some cases caused harm (I slipped on a wet rock, landed on my elbow, and got a boo boo). Who can I sue?
